hi i just read ur timeline and were almost the same IM a K3 visa too, I’ll be goin in the states on Nov 27′ 2007 My question is How long it will take to process the adjustment of status? Im here in canada and working as a live in caregiver ived been here for almost 2 yrs 3 mos now and ready to file my PR application but I got my K3 visa approved.

i wonder why you have a k3/k4 visa as your headline. k3 is for the spouse and k4 is for the child right? please elaborate on this because i am on a k3 visa too and has a child.

Yes, you are right. But I wrote “/” to indicate that K-4 is a derivative of K-3 visa, and that K-4 do not exist without a valid K-3petition. But anyway, you have a point. I should have used “and” instead of “/”. Thanks.

I know its way way to late for me to reply but here it is….
You need to request with NSO to know if your MC is already available in the system. If you are married less than 6 months, chance is, it is not yet endorsed to NSO Head Office. Usually, NSO will ask you to go back to the City or Municipal Hall where your MC is filed, and request for e-endorsement there. I think, there is a fee. Don’t worry. NSO will give you the instruction on what and where to go. Take care and good luck.
Hi ting. I hope that you can share with me infos regarding your application for K3 visa. We really dont want to spend money for immigration lawyer thats why online help are the only source of assistance that my husband and I could rely on.
My husband sent our I-130 packet on January and the USCIS online tracking registers the Date February 12,2008 as received and pending (thats around the same time you got yours posted online too ,,right?)
We have the WAC # to chk the status with, but theres no update as of today May 9. No letters nor emails from them. Its been 3 months now. Do we have to wait for any approval of our I-130?? or we can send our I-129 packet now without it??

hi tingting, my case is almost the same as ritz. but my pinoy husband is just a permanent resident of united states but is now working on his citizenship. per our estimate, he would prolly get his citizenship by almost end of this year. for your info, several months after my husband filed his application for citizenship last year, he also filed my I-130 this january 2008 so that his citizenship application and my I-130 could at least simultaneously be processed (he will just request for the change of category of my I-130 petition from a permanent resident petitioner to a u.s. citizen petitioner as soon as he gets his citizenship), but eversince i was given a WAC# last march 2008 for my I-130, i have not received any mails or updates yet until now. like ritz, i’m worried that it’s been months already, but i haven’t heard any news about my i-130 petition
for now, i am waiting for my husband to obtain his u.s citizenship, before we could file my I-129 or k3 application because we understand that my husband has to be a citizen first of america before he could file for my k3.
i hope you can give me pieces of advice about my case and additional info about i-130 application.

Well, my wife is a USC and we got married on 5th August 2007. She sent the I 130 packet on 27th August 2007 to the Texas center. They received it on 30th August. It was forwarded to Chicago lock box and then ultimately ended up in Vermont.
We received our NOA1 on 16th January 2008. After that, our case was approved on 26th August 2008. No updates after that yet. So our time line is more messed up then anyone elses.

The appointment letter was sent to me by the embassy. But that was a year ago. I heard somewhere that now, the embassy will email it and the appointment packet is already donwloadable at the embassy’s website.

The embassy does not approve anything until you have your interview. It is the judgment day. Basically from NOA2 to interview date, it will take around 2 months.

Do not worry about the transfer of your case. As long as you submit your packet in the address stated in the I-129F instructions form, you are good. Even if your I-130 is already forwarded to Vermont Service Center, DO NOT send you I-129F form there. Let USCIS do there job. Just follow the instructions, I tell, you are in the right track.

I have a checklist of assembling the I129F package from visa journey and it includes a “copy of I130 Transfer of Notice” and a “copy of the NOA.” I read somewhere that the NOA is the transfer of notice already. Yes, NOA 1 and Transfer Notice for I-130 are the same. NOA1 is issued already by the adjudicating service center of your case, and not the service center wherein you originally addressed your I-130 packet. Like for example — my I-130 was originally sent to the Texas Service Center, and it was transferred to the California Service Center. The NOA1 I got was already from the California Service Center. Also, if your case is going smooth (no RFEs) , you only get 2 NOAs from USCIS, the NOA1 and the NOA2, which is already the approval.
Proceed with your I-129F submission with the NOA1 of your I-130. You’ll be fine.
Yes, you should send your I-129F packet in the same service center where your I-130 case is held pending. You will know this because the address is located in the lowermost part of your NOA1 of your I-130.

What visa are you applying for? K-3 or K-1?Usually, i depends on the service center. Vermont is faster than California, but usually from NOA1 to NOA2, it ranges from 3.5 to 4 months.

If you signed up with the USCIS Case Status Service Online, you will receive an email for any major movement of your case– trasnfer of service center and adjudication result. For the time being, you can check if somebody “touched” your papers by checking “MY Portfolio”, then “Last Updated (mm/dd/yyy)”. If the date chnages, it means somebody must have looked into it…and this is a good sign. You are right. I was lucky enough to have my K-3 approved in about 3 months. For the current timeline, check this website..http://www.visajourney.com/timeline/stats.php?cfl=. It looks like the adjudication is longer now.

Thank God for creating this blog for people like us having a hard time figuring out the K3/K4 process. Ting, would you also help me with my inquiries. I recently got married last December 26, 2008. I got the marriage certificate from the local Civil Registrar where we filed it, is this not enough? Does our MC have to come from NSO to be valid or addressing the requirement? I checked on the links you posted i.e. visajourney.com on the requirements, and all it says is a copy of marriage certificate.
Second, can you suggest other evidence of a bonafide marriage other than what is mentioned in the website? Since we are newly married, we haven’t opened a joint account or brought a property together. A few days after we got married, he had to fly back to US for his work.

For your I-130 and I-129F, you can use a copy of the authenticated MC. Just make sure to have the MC in NSO secuirty pper during your interview. As early as now, file for electornic endorsement with your local registrar.
For I-130 and I-129F, you can send about 6+ pictures of you together, a copy of his used plane ticket, a copy of the hotel where tou stayed, a copy of money transfer recipt if there is any…remember — you need to have the original copies of thi documents during the interview.
As for us, these are the documents we submitted:
-A copy of Divorce Decree
-A copy of prepaid IDD phone cards
-A copy of three (3) recent Western Union receipts
-Three colored pictures together

it’s GLadys again,my spouse already received a letter from NVC showing the CASE Number and Invoice Number for our petition,they also asking to pay $70 for AOS(affidavit of support),i thought we can only download online and have notarized by either USCIS officer or public notary in USA,and we provided I-134 and it says there it’s not needed,it should be I-864,i’m a ‘lil bit confused,because in US Embassy (manila) website they say I-134(AOS) might be requested.Have you also gone through with this?is it I-134 or I-864 and have NVC to process this for us?and do we just need to pay them and wait again for their notice that we can go ahead and download the form online?

i got a letter from US Embassy now that i can request for an interview appointment by calling the VIsa Info SErvices,but i decided to signed up in VisaPoint for $10 but K3 visa is under immigrant visa and gave me message that it’s US EMbassy who’ll give you an appointment and can’t do it online,how did you get a medical and interview dates in VIsa Info system?
and do i have to wait for the letter of my appointment from NVC or US Embassy?

There is NO NEED to notarized the affidavit of support. Your sponsor’s signature will suffice.
You can pay you visa fee in advance at BDO. Pay it is its peso equivalent. The bank will give you the DS form needed. http://www.bdo.com.ph/Promos/US_payment.htm
K-3 does not scheduled the interview through Visapoint. You should call the embassy for the appointment. Here is how to scheduled your visa interview appointment:

I only had a 1-way ticket. They will take the sealed document that the embassy gave you. It is just easy. The questions are only basic info, like your name, brithday, husband’ name..that kind of thing.

I received a case number from NVC when our case entered into their system. And today, I received a mail from the consular that my case is elgible to have an interview schedule, however, I noticed that the case number written on it is different from what the NVC gave us. Is there such thing as NVC case number, and an MNL case number. Are they really different? Or something is wrong. Please help me. Thank you and more power!
I have the same question with Gladys about the MNL case numbers. Both case numbers start with MNL, but contain different numerical figures. (MNL from NVC is different from MNL case number given by the USEM)

The MNL case number stated there should be the same. The NVC letter is only to tell you that they have received your file and that they will be forwarding it to the appropriate Consular offices within a week or so. It will include your INS number (receipt number from your NOA1), your case number, and the address where your case will be processed (Consulate/Embassy).
Anyway, do not worry too much about that. Use the one the embassy sent. Besides, during your call to schedule your appointment, the embassy will verify your identity. That’s the only time you will know if something is wrong. But I doubt it.

I’m married with such a wonderful american citizen last May 15,2008. He started to file our petition ( I-130 Immigrant Visa) last October 15, 2008. Then after almost 2 months, he received a “Notice of Action” ( Form I-797) receipt notice. Just yesterday ( March 8, 2008), my husband received the approved petition from the USCIS. Ahm, I’d like to inquire about the next step to take up and what are the documents to be prepared by my hubby as well as me? And how long does it take for me to be there in the states?Looking forward to reading your prompt reply regarding this matter.

Based on your post, I believe that you did not file for form I-129F, which is needed for K-3 visa. Hence, you are obviously going for the CR-1 non-immigrant visa.

You can download your form here http://travel.state.gov/visa/frvi/forms/forms_1342.html, then have BDO validate your form. But if you dont want the trouble, just let BDO gave you the validated forms. Hence, when you go to the bank, you do not need to bring any form at all.

My wife in the Philippines had her over all medical examination with her private doctor, until she had her sonogram, they found out that she has “ovarian dermoid cyst”. I’d like to ask, is sonogram included in their medical exam at SLEMC? As far as I’m concern, I told my wife to do the operation here in my place so she can use my insurance. Is this possible? Pls advice. Thank you.

i just got an email from NVC about my petition and sent me a fee bill of $400 for immigrant visa processing,remember when i got a letter from them,the case number is different from what i received from the embassy and NVC,it’s very confusing now because my interview will be on the 13th,i’m done with everything,the payment,medical,as in everything. It’s after i sent them the change of address form and choosing my agent which is my husband,i’m not sure if it’s for CR1 application but i’m applying for K3 visa,do i have to contact NVC about this?

I need your expert advice… But just to give you an idea – I am a US citizen who got married to a Filipino Citizen last Feb. 2009. I sent I-130 around 2nd week of March and the petition got approved on 4/3/2009…pretty fast, huh?! That being said, USCIS forwarded my appliation to NVC (nat’l visa center)…. and this is where I’m at now…
Now this is my dilema, I just found out about k3 visa and im confused… I honestly don’t know if I should still apply for a K3 visa. I really want my husband to come here na kse i think, I’m pregnant! I called USCIS and inquired about K3 visa but the girl that I spoke with didn’t really help me as much.
My question to you is… should i apply for a K3 visa or should I just wait for NVC to process my application for I-130? I heard that K3 is faster? Is that true?
